Duties: The role of County Counsel is established by N.J.S.A. 40A:9-43. County Counsel is the Department Head for the County’s Department of Law. County Counsel renders legal assistance and advice to the Board of Chosen Freeholders, County Administration, Clerk to the Board of Chosen Freeholders and all Department and Division Heads. These responsibilities include, but are not limited to the following:

• Preparation of Board Resolutions, contracts and shared services agreements
• Representation of the County and its respective departments in disciplinary matters, departmental hearings, grievances, arbitrations, labor disputes, and appeals relating to the same
• Labor negotiations
• Providing advice on matters relating to bonding, procurement, public contracts law, and other similar issues that may arise from day to day
• Matters before the Public Employees Relations Commission
• Civil commitment hearings
• Representation of the Cumberland County Agricultural Development Board including attendance at meetings
• County Counsel may also initiate or defend litigation on behalf of the County, its divisions and agencies as may be necessary or desirable
• Representation of the Constitutional Officers in connection with disciplinary matters, personnel issues, administrative matters, in addition to election law matters
• Representation of the Cumberland County Insurance Commission, a self-insurance and joint insurance arrangement through the NJCEL on behalf of the County and its related entities
• Attendance at all Freeholder meetings and other scheduled meetings, which may take place during day and evening hours and other meetings upon request
• Bail remission applications in the Superior Court
• Trains County employees on various topics including but not limited to sexual harassment and discrimination
• Any other legal matters which may be brought to the attention of the Legal Department

County Counsel assigns, monitors, and supervises outside counsel with respect to assigned litigation matters. County Counsel also supervises the work of any Assistant County Counsel.

Requirements: License to practice as an Attorney-at-Law in the State of New Jersey with a minimum of fifteen (15) years of experience in public representation, litigation, and transactional work. Working knowledge of the Local Public Contracts Law, Open Public Meetings Act, Open Public Records Act, Local Lands and Buildings Act, and generally Title 40 and 40A with respect to the operation of County Government, and the provisions of New Jersey Tort Claims Act, N.J.S.A. 59:1-1, et seq.

Hours: 40+ hours per week. Typical work shift is Monday through Friday, 8:30am – 4:30pm. However, this position requires work beyond the typical shift.

Note: Offers of employment for this title are contingent upon successful completion of physical fitness testing that includes drug screenings and criminal background checks.
