PUBLIC NOTICE

COUNTY OF CUMBERLAND

 

SALE OF PROPERTY OWNED BY THE COUNTY

OF CUMBERLAND PURSUANT TO RESOLUTION

NO. 2009-481 ADOPTED BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTY OF CUMBERLAND

 

The County of Cumberland intends to sell the property (approximately 5 acres) located in the Township of Hopewell known as Block 74, Lot 23.01.

 

The auction of this property is subject to the following restrictions:

 

1.         The property shall be offered by sale by open public auction to the highest bidder, with reserve, on Thursday, October 1, 2009, at 1:00 P.M. prevailing time at the Cumberland County Administration Building, Freeholder Meeting Room, located at 790 East Commerce Street, Bridgeton, New Jersey.

 

2.         The auction shall be with the reserve of a minimum bid of One Hundred Twenty Thousand Dollars Zero Cents ($120,000.00). Upon completion of the auction, the highest bid shall be reported to the Board of Chosen Freeholders of the County of Cumberland. The Board shall accept the highest bid or reject same. Such acceptance or rejection shall be made not later than the second regular meeting of the Board of Chosen Freeholders of the County of Cumberland following the auction sale. If the highest bid is not accepted or rejected by the second regular meeting, said bid shall be deemed to have been rejected. Closing shall take place within forty five (45) days of the acceptance of the highest bid.

 

3.         Upon the close of bidding on the property, the highest qualified bidder designated by the County Director of Purchasing, shall submit cash, certified check or a combination thereof in the amount of ten percent (10 %) of their bid and shall immediately execute an offer to purchase at the bid price. The offer to purchase shall be contingent upon approval by the Board of Chosen Freeholders and shall include other terms and conditions set forth by Cumberland County Counsel. The form of Contract to be utilized may be reviewed in advance by contacting Cumberland County Counsel. If the highest bid is rejected by the Board of Chosen Freeholders, the deposit tendered shall be immediately returned to the bidder.

 

4.         Title shall be conveyed by Quitclaim Deed with final payment to be made at the closing in cash or certified check.

 

5.         Failure to comply with any of the requirements or to close on the property shall entitle the County to rescind the prior bid approval, terminate any and all rights the designated bidder may have in the property and retain all monies theretofore deposited.

 

6.         The property shall be conveyed “as is” and subject to existing encumbrances, liens, zoning regulations, easements, other restrictions, such facts as an accurate survey would reveal and present or future assessments for the construction of improvements benefiting said property.
